1. Introduction

Rushbill is a billing service platform designed to help users pay for various services, including but not limited to bill payments, purchasing tariffs, and other related transactions.

3. Account Registration and Use

3.1 Eligibility: To use our platform, "You" must be at least 18 years old and possess the legal right and responsibility to enter into a binding contract.

3.2 Account Creation: In order to use certain features of the Service, "You" are required to create a user account, for that course "You" must provide accurate and complete information when creating an account on our platform. "You" are responsible for maintaining the confidentiality of "Your" account credentials and for all activities that occur under "Your" account.

3.3 Acceptable Use: "You" agree to use our platform solely for lawful purposes and in accordance with these Terms. "You" shall not engage in any activities that may disrupt, compromise, or abuse our services or systems.

Acceptable Use, Account Integrity, Suspension, Termination, and Enforcement

You agree to use the Rushbill Platform, including all websites, mobile applications, APIs, integrations, payment services, and related systems, solely for lawful purposes and in compliance with these Terms, applicable laws, regulations, industry standards, and any policies published by Rushbill from time to time.

As a condition of access to and use of the Platform, you represent and warrant that all information provided to Rushbill is accurate, complete, current, truthful, and not misleading. You agree to promptly update any information that becomes inaccurate or outdated.

Rushbill reserves the absolute right, at its sole discretion and without prior notice, to monitor, review, investigate, restrict, suspend, terminate, or permanently ban any account, API integration, application, device, business profile, or user where Rushbill reasonably believes that:

  1. False, inaccurate, incomplete, fraudulent, misleading, or stolen information has been provided;
  2. The account was created, accessed, controlled, or operated through unauthorized automation, bots, scripts, reverse engineering tools, unauthorized APIs, or any method intended to circumvent Rushbill’s systems, controls, security measures, or onboarding requirements;
  3. The user has engaged in suspicious, unusual, deceptive, fraudulent, abusive, malicious, unlawful, or high-risk activity;
  4. The user has attempted to manipulate, exploit, interfere with, compromise, test, probe, overload, damage, or gain unauthorized access to the Platform, its infrastructure, databases, networks, users, merchants, partners, or services;
  5. The activity may expose Rushbill, its affiliates, users, financial partners, regulators, or service providers to financial loss, legal liability, reputational harm, regulatory sanctions, security threats, operational disruptions, or other risks;
  6. The account has been linked directly or indirectly to money laundering, terrorism financing, fraud, identity theft, cybercrime, unauthorized payment activity, sanctions violations, or any other unlawful conduct;
  7. The user breaches these Terms, any applicable policy, or any legal or regulatory requirement.

Where Rushbill identifies or suspects prohibited activity, Rushbill may immediately and without liability:

  • Restrict or suspend access to the Platform;
  • Freeze transactions or account functionality;
  • Place holds on funds pending investigation;
  • Refuse, reverse, delay, or cancel transactions where permitted by law;
  • Request additional verification, documentation, or information;
  • Report the activity to financial institutions, payment processors, law enforcement agencies, regulators, or other competent authorities;
  • Permanently terminate the account and any related accounts.

Rushbill may associate and link accounts, businesses, devices, IP addresses, payment instruments, identities, beneficial owners, agents, representatives, affiliates, or other identifiers that appear reasonably connected. Where an account is suspended or terminated for violations of these Terms, Rushbill may suspend, restrict, or terminate any related account that shares substantially similar identifying information or is reasonably believed to be under common ownership or control.

Any funds, assets, balances, credits, rewards, or other valuables associated with a restricted account may be temporarily withheld, frozen, reserved, or otherwise restricted pending investigation, compliance review, legal process, dispute resolution, regulatory directives, chargeback proceedings, or law enforcement requests. Rushbill reserves the right to deduct fees, losses, chargebacks, fines, penalties, investigative costs, recovery expenses, and other amounts lawfully owed to Rushbill before releasing any eligible balance.

Users found to have engaged in fraudulent, malicious, unlawful, or harmful activities shall remain fully liable for all losses, damages, claims, penalties, fines, costs, expenses, and liabilities arising from such conduct.

Rushbill expressly reserves the right to commence civil proceedings, seek injunctive relief, recover damages, and pursue all available legal and equitable remedies against any person or entity that causes loss, damage, disruption, liability, reputational harm, or regulatory exposure to Rushbill. To the fullest extent permitted by law, offending users shall be responsible for reimbursing Rushbill for reasonable legal fees, attorney fees, court costs, investigative expenses, expert fees, collection costs, and other enforcement-related expenses incurred in connection with the violation.

Nothing in these Terms shall limit Rushbill’s right to cooperate fully with law enforcement authorities, regulatory agencies, courts, financial institutions, or other governmental bodies in connection with investigations, enforcement actions, or legal proceedings.

4. Payment and Billing

4.1 Payment Processing: By using our platform, "You" authorize Rushbill to process payments on "Your" behalf. We may use third-party payment processors to facilitate transactions, and their terms and conditions may apply.

4.2 Payment Information: "You" must provide accurate and up-to-date payment information. "You" are responsible for maintaining the validity of "Your" payment methods and ensuring sufficient funds are available for any charges incurred.

4.3 Fees and Charges: We reserve the right to modify our fees and pricing model at any time. Any changes will be communicated to "You" through our platform or by email. "You" agree to pay all fees and charges associated with "Your" use of the Service in accordance with the pricing and payment terms provided to "You".

5. User Conduct

"You" agree to use the Service in strict compliance with all applicable laws and regulations. "You" may not use the Service for any illegal or unauthorized purpose, or to transmit any content that is unlawful, defamatory, obscene, or otherwise objectionable.

6. Intellectual Property

All content and materials available through the Service are the property of Rushbill or its licensors and are protected by copyright and other intellectual property laws.

6.1 Ownership: Rushbill and its legal licensors own all intellectual property rights in the platform, including but not limited to trademarks, copyrights, and patents. "You" are granted a limited, non-exclusive, non-transferable license to access and use the platform for its intended purposes.

6.2 Restrictions: "You" shall not (either as a user or otherwise) modify, reproduce, distribute, create derivative works, reverse engineer, or attempt to access the source code of our platform without prior written consent from Rushbill.

7. Limitation of Liability

In no event will Rushbill, or its affiliates, officers, directors, employees, agents, licensors, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with "Your" use of the services, including but not limited to loss of profits, loss of data, business interruption, or other intangible losses, even if Rushbill has been advised of the possibility of such damages.

7.1 Disclaimer of Warranties: Our platform is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 Limitation of Liability: To the maximum extent permitted by law, Rushbill shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to "Your" use of our platform, even if advised of the possibility of such damages.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the specified Jurisdiction of Rushbill. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the region approved by the governing body of the platform.

9. Changes to Terms

Rushbill reserves the right to update or modify these Terms at any time without prior notice. "Your" continued use of the Service after any such changes constitutes "Your" acceptance of the revised Terms.

10. Disclaimer

The services, information, content, and materials provided through this platform are provided "as is" and without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Rushbill does not warrant that the services, information, content, materials, or products included therein are free of viruses or other harmful components.

11. Cancellation of Payment Instructions

Once we have received "Your" Payment Instruction, "You" cannot cancel it.

12. Fees and Charges

For each Payment "You" make, "You" must pay us the applicable Service Fee (as detailed on the Site/app). Payment becomes due at the time "You" submit the Payment Instruction.

If "You" submit a Payment Instruction that results in us becoming liable for charges (including but not limited to chargeback or other fees which we are obliged to pay), "You" must reimburse us for all such fees.

A surcharge may apply for processing credit cards in certain jurisdictions. The amount of the surcharge will be notified to "You" at the time of the card payment.

13. Definition

Account: means the non-interest-bearing account (Profile) to be opened and operated by "You" with Rushbill, through the Site with the following features that enable "You".

Recipient: means the payee, who receives the money through the use of the Money Transfer Service.

Service Fee: means our fees for the provision of the Services as described on the Site payable by "You" to Rushbill.

Service Provider: means technical partners, international transfer money operators, commercial banks, service providers, third party service providers who we work with to provide the Services to "You".

User/"You": implies customer of Rushbill, who is a user of the Site and has opened an Account with Us and/or utilizes our Services.

14. Privacy Statement

Your use of this Site signifies "Your" continuing consent to Rushbill’s Privacy Notice which "You" can examine any time by clicking on our Privacy Notice link on the Site. Personal information that "You" supply to us and any information about "Your" use of the Site that we obtain will be subject to Rushbill’s Privacy Notice on this Site. We may provide information about "You" and "Your" Transactions to government authorities and law enforcement agencies (but on high demand relating to either crime or any unlawful act), as described in our Privacy Policy. "You" authorize us to make any inquiries, to "You" or to others, which are necessary to validate the information that "You" provide to us.

15. Trademark

Trademarks, service marks, and logo appearing in this Site are the property of Rushbill or the party that provided the trademarks, service marks, and logos to Rushbill. Rushbill and any party that provided trademarks, service marks, and logos to Rushbill retain all rights with respect to any of their respective trademarks, service marks, and logos appearing in this Site.
